Luxembourg and Austria are threatening to block legislation that would require EU member states to increase their co-operation against tax evasion. The Swedish presidency of the EU wants finance ministers to reach a deal on the proposed law next week (11 November) and the European Commission has accused the two countries of resorting to stalling tactics because they do not want to share more tax information.
The legislation covers information on income derived from salaries as well as from dividends, capital gains and pensions, which would allow tax officials from one member state to travel to other EU countries to pursue their inquiries. It would also prohibit bank secrecy and forbid governments denying another member state co-operation similar to that which it offers any non-EU government.
Luxembourg and Austria argue that the legislation should be agreed at the same time as a reform of the EU’s savings tax directive, which requires member states to share information on citizens’ income.. A proposal to strengthen the law is still under discussion between national governments.
The two governments last month blocked the approval of an anti-fraud agreement with Liechtenstein and the adoption of mandates that would allow the Commission to negotiate similar agreements with Andorra, Monaco, San Marino and Switzerland.
Both Austria and Luxembourg have a partial opt-out from the savings tax directive, but would be required to apply it fully if Liechtenstein, Switzerland, Monaco, San Marino and Andorra exchange tax information with EU governments on request.
