Samsun Logix becomes latest shipping victim to file for Chapter 15 protection

SAMSUN Logix has become the fourth shipping company to seek parallel bankruptcy protection in New York, after being granted similar protection by Seoul’s central district court.
The move is a bid to stave off attempts to attach dollar-denominated Samsun Logix funds as they electronically pass through New York, and an attempt to ensure equal payment treatment of all creditors if the request is granted.
In its Chapter 15 filing in the Southern District of New York, Samsun Logix estimated its creditors to number “between 200 and 999” and said it had “more than $100m” in debt. Estimated assets were also indicated as “more than $100m”.
Chapter 15 filings are picking up in popularity, particularly as an antidote to the raft of Rule B proceedings being brought against foreign companies.
However, since Chapter 15 is envisaged as an internationally recognised parallel to Chapter 11, the main US bankruptcy statute, only companies that have filed for bankruptcy in a foreign jurisdiction can avail themselves of this protection.
Atlas Shipping, Armada Singapore and Britannia Bulk have also filed for Chapter 15 in the US, according to legal experts.
Unlike Chapter 11, which allows an automatic stay against actions such as Rule B, a Chapter 15 petitioner has to request such an injunction separately. In Armada’s case, a creditor has challenged the validity of this separate petition.
Rule B permits ex parte attachment of defendant funds as they pass through New York’s electronic money transfer system. The defendant need not be aware that its cash is being seized and need not even be made aware of the Rule B complaint before such seizure.
Rule B attachments, once effected, allow the plaintiff to hold on to the attached cash until the defendant has either settled out of court or agreed an arbitrated settlement.
Rule B plaintiffs have an advantage over other ordinary creditors. If Chapter 15 and the related injunction against Rule B claims are granted, the debtor can seek to claw back any such funds already attached and put the money back in the common pot.
Known Rule B claimants against Samsun Logix in the US include HB Hope Shipping ($1.2m), Racing Shipping ($399,000) and ER Denizcilik ($681,000).
Samsun Logix has itself brought a Rule B action against Tianjin Tianhui Shipping for $1.9m.
Separately, at least three legal proceedings against Samsun Logix are under way. These include DryShips, which is in arbitration for compensation after Samsun Logix pulled out of a deal to buy a panamax bulker. Meanwhile, Hellenic Carriers and Genco Shipping & Trading are chasing Samsun Logix for unpaid charterhire.

Hebi ga stari imas kratku memoriju.Ja sam ipak nesto duze u ovome i sjecam se kad je drzava davala pomoc svim brodarima ukljucujuci i ATPL koji tada nije bio privatiziran. Neznam kako je zavrsilo sa drugima ali mislim da SPPL dan danas nije vratila drzavi (HFP) pozajmicu.
